Our terms of sale for orders, products, custom-made items, delivery, payment, and warranty.

1. Scope of Application
These General Terms and Conditions of Sale apply to all orders placed by consumers or entrepreneurs via FyDa Printwerk's online shop.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.
An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.
Deviating conditions of the customer shall only apply if we have expressly agreed to them in writing.

3. Products and Product Descriptions
FyDa Printwerk offers, in particular, 3D printed products, decorative items, picture frames, accessories, and, where applicable, custom-made products according to customer specifications.
The essential characteristics of the goods are derived from the respective product description in the online shop.
3D printed products are items manufactured layer by layer. Minor production-related deviations, such as visible layer lines, small dimensional tolerances, minimal color variations, surface textures, or material-typical characteristics, do not constitute a defect, provided they do not significantly impair the ordinary use of the product and correspond to the product description.
Images, colors, and representations in the online shop may differ slightly from the actual product depending on the screen display.
4. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.
The customer can select products and place them in the shopping cart. Before submitting the order, the customer can check and change their entries.
By clicking the order button, the customer submits a binding offer to purchase the goods contained in the shopping cart.
After receipt of the order, the customer receives an automatic order confirmation by email. This order confirmation confirms receipt of the order.
The purchase contract is concluded as soon as we expressly accept the order, dispatch the goods, or begin manufacturing a custom-ordered product.
For custom-made products, manufacturing can only begin after all necessary details, such as size, color, motif, text, or special request, have been fully clarified.
5. Prices and Shipping Costs
All prices stated in the online shop are in Euros.
Shipping costs are shown separately in the ordering process and are to be borne by the customer, unless free shipping is expressly indicated.
If VAT is shown, the prices stated in the online shop include the applicable statutory VAT.
Additional costs, such as customs duties, import duties, or taxes for deliveries outside the European Union, may be borne by the customer, where such costs arise.
6. Payment Terms
The payment methods available in the online shop are displayed to the customer during the ordering process.
Payment processing is carried out via the payment service providers integrated into the shop, in particular via Shopify Payments and/or other payment providers offered.
Unless otherwise stated, the purchase price is due immediately upon completion of the order.
In the event of failed payment, we reserve the right not to process or cancel the order.
7. Delivery and Shipping
Delivery will be made to the delivery address specified by the customer in the order process.
The estimated delivery times are stated in the online shop or within the ordering process.
For custom-made products, the production and delivery time only begins once all information required for manufacturing is fully available and payment has been successfully completed.
Should a product exceptionally be unavailable or delivery be delayed, we will inform the customer immediately.
Partial deliveries are permissible, provided they are reasonable for the customer.
8. Custom-Made and Personalized Products
Custom-made products are products manufactured according to the customer's individual specifications. This includes, in particular, special dimensions, desired colors, personalized inscriptions, individual motifs, logos, one-off productions, or other customer requests deviating from the regular shop offer.
The customer is responsible for ensuring that the information, dimensions, texts, files, motifs, or other specifications submitted by them are correct.
For personalized products, we generally do not check texts, names, dimensions, or motifs for factual correctness, spelling, or design suitability, unless expressly agreed otherwise.
Once manufacturing has begun, custom-made products usually cannot be changed or canceled.
We reserve the right to refuse orders if the submitted content is illegal, discriminatory, offensive, glorifies violence, infringes trademark rights, infringes copyrights, or cannot be implemented for other legitimate reasons.
9. Rights to Customer-Provided Content
If the customer submits their own texts, logos, images, files, motifs, or other content, they assure that they are authorized to use this content and that no third-party rights are violated.
The customer indemnifies FyDa Printwerk from claims by third parties arising from illegal use of the content provided by the customer, insofar as the customer is responsible for the infringement.
10. Retention of Title
The goods remain the property of FyDa Printwerk until full payment has been received.
11. Right of Withdrawal for Consumers
Consumers generally have a statutory right of withdrawal.
Details can be found in our cancellation policy, which is available in the online shop.
The right of withdrawal does not apply to goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer.
This applies in particular to individually manufactured or personalized products, special dimensions, desired colors, inscriptions, logos, motifs, or other custom-made items according to customer wishes.
For regular standard items from our shop, the statutory right of withdrawal applies, unless a legal exception applies.
12. Returns
If a consumer exercises their right of withdrawal, they must return the goods to us within the statutory period.
The direct costs of returning the goods shall be borne by the customer, unless otherwise specified in the cancellation policy.
The goods should be returned securely packaged to avoid transport damage.
The customer shall only be liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
13. Warranty
The statutory warranty rights apply.
If the delivered goods are defective, the customer is entitled to the statutory rights.
For 3D printed products, minor manufacturing-related peculiarities typical for the 3D printing process do not constitute a defect, provided the product corresponds to the description and can be used as intended.
Damage caused by improper use, excessive load, heat exposure, moisture, incorrect cleaning, alteration of the product, or misuse does not give rise to warranty claims.
14. Care and Usage Instructions
3D printed products can be sensitive to heat, direct sunlight, moisture, mechanical stress, or certain cleaning agents, depending on the material.
The customer must observe the respective product and care instructions.
Unless expressly stated otherwise, FyDa Printwerk products are not intended as toys, not for toddlers, and not for safety-critical applications.
15. Liability
We are liable without limitation for damages resulting from injury to life, body or health, as well as for intent and gross negligence.
In the event of simple negligence, we are only liable for the breach of essential contractual obligations. Essential contractual obligations are those obligations whose fulfillment enables the proper execution of the contract in the first place and on whose observance the customer may regularly rely.
In these cases, liability is limited to the typical and foreseeable damage for the contract.
The aforementioned limitations of liability do not apply insofar as mandatory statutory provisions conflict therewith.
16. Transport Damage
If goods are delivered with obvious transport damage, we ask the customer to report this to the delivery person immediately if possible and to contact us as soon as possible.
The customer's statutory rights remain unaffected by this.
17. Vouchers and Discount Codes
Vouchers and discount codes can only be redeemed within the specified period and only under the respective conditions.
Cash payment is excluded, unless expressly stated otherwise.
Vouchers and discount codes cannot be applied retrospectively to already completed orders.

19. Online Dispute Resolution / Consumer Dispute Resolution

We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board, unless there is a legal obligation to do so.
20. Data Protection
Information on the processing of personal data can be found in our privacy policy, which is available in the online shop.
21. Applicable Law
French law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
For consumers, this choice of law only applies insofar as the protection provided by mandatory legal provisions of the state in which the consumer has their habitual residence is not withdrawn.
22. Contract Language
The contract language is German, unless otherwise specified in the online shop.
23. Final Provisions
Should individual provisions of these terms of sale be or become wholly or partially ineffective, the validity of the remaining provisions shall remain unaffected.
Changes or additions to these terms of sale are reserved, insofar as they are legally permissible.
